Wan Hai Reminds Filing Compliance Again: Concealment, Omission, Misstatement or Default Fee up to USD 100,000/UNIT

On April 2, Wan Hai Shipping once again gave a strict reminder on the issue of cargo declaration compliance: in case of inaccurate declaration such as concealment, omission, misdeclaration, etc., Wan Hai Shipping will claim corresponding responsibilities and losses from the responsible party according to the relevant international conventions and the terms of the transportation contract; and in case of suspected criminal acts, the matter will be transferred to the judicial authorities for handling according to the law.

In order to guarantee the safety of ships, cargoes and other third parties, maintain a safe and orderly maritime transportation environment and protect the rights and interests of customers, Wan Hai Shipping emphasizes that customers must make true, accurate and complete declarations of cargo information. If there is any inconsistency between the declaration and the actual situation, the carrier has the right to collect liquidated damages from the responsible party according to the contract of carriage and recover the relevant losses incurred as a result.

The specific points of the rule are set out below:

(a) Dangerous goods declaration requirements and liquidated damages

Dangerous goods containers should provide true CLASS, UNNO, detailed name of goods, and submit Dangerous Goods Declaration and packing documents. In case of concealment, omission or discrepancy, the responsible party shall pay USD 100,000/UNIT as liquidated damages and shall pay within 7 days after receiving the notice.

(b) Liability for non-hazardous material underreporting/underreporting/misreporting

In the event of concealment, omission or misdeclaration of non-hazardous goods, the responsible party shall also be liable to pay liquidated damages in the amount of USD 100,000/UNIT and shall bear all risks, liabilities and costs of damages arising therefrom; the relevant payment shall be made within 7 days from the date of receipt of the notification.

(c) Deposit mechanisms and subsequent cost-sharing

In the event of concealment, omission or misstatement, the responsible party shall pay USD 100,000/UNIT as deposit immediately upon notification by the carrier. The deposit will be used to cover any subsequent costs and damages that may be incurred, including but not limited to: box loss, demurrage overrun charges (overrun charges may be calculated at 3 times if underreporting is involved), wharfage charges, local customs handling charges, etc., as well as all risks, liabilities and damages arising from security incidents. If the deposit is not enough to cover the actual costs incurred, the responsible party is still required to make up the difference.

In addition to the above liquidated damages and deposit arrangements, the Carrier reserves the right to pursue further claims and liabilities against the responsible party.
